Without prejudice nature of a scheme set up to provide victims with compensation - should the existence of the scheme and the documentation under it be protected by without prejudice privilege and therefore be kept from the trial judge.  See discussion paras 46 onwards.  The fact that it was a form of alternative dispute resolution did not make it privileged.
