#1 Buy certainty

Mediate now to take control of the future of your dispute.  Claimants might need cash now, defendants might not be still in business in a few weeks' time. In a time when everything else remains tentative, to be collaborative, to move a dispute forwards and to achieve settlement will provide some welcome certainty for all parties.

#2 Availability

Never will you have a better (and easier) time in getting all the parties to a dispute around a (virtual) table.  Key people are available and parties can't make too many excuses about dates not being suitable.

#3 Costs uncertainty

The Lord Chief Justice has urged parties to explore the possibility of compromise.  How will a failure to mediate now be viewed by the Court when final costs are apportioned?
